(i) Trade Mark Search
Require (a) Trade Mark word and / or Logo / Device
(b) List of goods / services in relation to which Trade Mark will be
used.
(c) Copy of Logo (if applicable).
(d) Searches also conducted of: - Companies Records
- Domain name Registry
(ii) Trade Mark Application
Require (a) Power of Attorney
(b) 10 x clear prints of logo / device: preferably in black & white
although application can be made for logo in a specific colour
(c) Details of Applicant: Individual or
Entity: Signatories
Capacity
(e) List of goods / services
TRADE MARK
APPLICATION PROCEDURE
Trade Mark forms lodged at Registrar: - Who then issues a Trade Mark
application number and filing date.
Trade Mark application is placed in the queue for examination by
Registrar and he either:
(a) Accepts application or:
(b) Provisionally refuses: Applicant is given opportunity to respond
and make submissions to support acceptance.
TRADE MARK APPLICATION
Trade Mark application is accepted: It must be published in the
Government Gazette and lies open for inspection for 3 months.
Any interested party may oppose the application.
If opposition – Applicant submit evidence of an affidavit supporting
application
Registrar accepts / rejects and gives his decision.
If the Trade Mark opposition is successful then the Trade Mark
application is refused
If the opposition is unsuccessful then the Trade Mark application
proceeds to Registration, following which a Certificate of
registration is issued.
